The permits get you open once. The rest recurs forever
Every guide to opening a restaurant in New York is a permit checklist, and permits are the part with an end date. The obligations that outlast the opening are the ones that close kitchens: a hood that has not been cleaned on schedule, a suppression system out of inspection, an extinguisher with a stale tag. This page is about those.
The mistake that costs the most
Treating compliance as a series of separate vendors called when something expires. Every interval runs on its own clock, nobody reminds you, and the first time they line up is usually an inspection you are failing.
What recurs, how often, and what it costs
Published prices, the same ones on our service pages. Ranges are wide because a two-hood pizzeria and a hotel kitchen are not the same job.

The checklist, in the order things block you
Sequenced by what stops you progressing rather than grouped by agency, because the expensive delays come from doing things in the wrong order.
Before you sign the lease
- Confirm the Certificate of Occupancy allows food service, and check the place of assembly threshold if you expect over 74 occupants
- Ask which community district the building is in and whether its Local Law 152 gas piping certification was filed
- Check there is a route for hood exhaust to the roof. Retrofitting one is the single most expensive surprise
Build-out
- Architect or engineer prepares and seals construction documents
- DOB alteration filing, submitted by a licensed party or registered filing representative
- Licensed Master Plumber for gas and plumbing work
- Hood, duct and make-up air installed; fire suppression system installed and permitted through FDNY
Paperwork that takes weeks
- Certificate of Authority to collect sales tax, with the address matching the establishment
- Workers compensation and disability insurance naming DOHMH as certificate holder, or Form CE-200 if you have no employees
- Food Protection Certificate for the supervising manager
Opening
- Submit the DOHMH food service permit application, $280
- You may begin operating 22 days later, or call 212-676-1600 for a pre-operating inspection to open sooner
- First hood cleaning and suppression inspection scheduled before service, not after
First year
- Set the hood cleaning interval from what the system actually looks like after 90 days
- Semi-annual suppression inspection, annual extinguisher service, emergency lighting tests
- Renew the health permit annually; it expires one year from the end of the month you applied

Gas piping inspection under Local Law 152 sits with the building owner rather than the tenant. If you are signing a lease, ask which community district the building is in and whether the last certification was filed. Both are checkable before you commit.
Common questions
- What compliance costs should I budget for in year one?
- Separate one-time setup from recurring. Installation of a kitchen fire suppression system and any build-out work is one-time and permitted through FDNY and DOB. Recurring is the part people underestimate: hood cleaning from $650 quarterly, suppression inspection from $580 semi-annually, extinguishers from $400 a year, emergency lighting at $5 to $15 a fixture, and grease trap service at $250 to $600 per visit at whatever interval your kitchen actually needs.
- How often does a new restaurant need hood cleaning?
- NFPA 96 sets the frequency by cooking volume, not by calendar. Most full-service kitchens land on quarterly; high-volume fryer and wok lines go monthly; a low-volume sandwich counter can be semi-annual. Your first cleaning establishes the baseline, and the interval should be set from what the hood actually looks like.
- Do I need a Local Law 152 gas piping inspection?
- If the building has gas piping and is not a one- or two-family home, yes, once every four years on a schedule set by the building’s community district. This is the landlord’s obligation as building owner rather than the tenant’s, but it is worth confirming who is filing it before you sign, because an open Notice of Deficiency on the building becomes your problem operationally.
- Can Empire handle the permits?
- We coordinate them. Every submission is made by someone entitled to make it: construction documents are sealed by a licensed architect or engineer, DOB filings go through a registered filing representative or the licensed trade whose work it is, and gas piping through a Licensed Master Plumber. The DOHMH food service application we can submit directly under a signed Authority to Act. We hold the schedule across all of it, then carry the recurring work afterwards.
- What do inspectors actually ask for?
- Documentation, usually before they look at the equipment. Current hood cleaning certificate with the date and the cleaner’s details, suppression system tag, extinguisher tags, and the records behind them. Work done without a record is treated as work not done.
